Provisions for testing during martial law: what you need to know

During the conclusion of an employment contract during the period of martial law, a probationary period may be established for any category of workers. The Inspection Department in Zaporizhia region has clarified the details of this practice.

Probationary Period During Martial Law

According to the Labor Code of Ukraine, a probationary period cannot be established for employees who have not yet reached the age of 18, but this prohibition applies only in peacetime.

During martial law, the probationary period clause may apply to any employees (in accordance with Article 2 of the Law of Ukraine «On the organization of labor relations in conditions of martial law» dated March 15, 2022, No. 2136-IX).

It is important to note that the establishment of a probationary period is not mandatory for the employer, but it is their right. Labor legislation also applies to employees during probation.
